GENERAL SALES CONDITIONS
These conditions aim to define each party’s obligations and the various steps in order processing.
Article 01 - limitation of liability:
The user acknowledges having read these conditions and undertakes to comply with them.
The user must accept the conditions for the purpose of ordering.
Users of the ‘brise-vue.com’ website acknowledge having the necessary competence and means to access and use the site.
They acknowledge having checked that the computer configuration used does not contain any viruses and works perfectly.
We make every effort to provide users with accurate information but we cannot be held responsible for errors, the lack of availability or the presence of a virus on our website.
All supplied data is for information only and we cannot guarantee that the details provided on our website are accurate, complete and up to date.
Consequently, the user acknowledges using this information exclusively under his/her own responsibility.
Article 02 - payment:
The website proposes several methods of payment:
- Secured payment by bank card
- Payment by bank transfer (RIB or IBAN indicated on the site at the time of order)
- Payment by cheque (in France only):

Article 03 - prices:
The prices indicated are in euros and are inclusive of tax.
All orders are invoiced in euros and payable in euros.
The applicable vat is 20% for all the products.
Bouillon s.a.r.l reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices applicable at the time of order, subject to availability.
A fixed sum for participation of freight charges will be invoiced in addition.
Article 04 - delivery:

The lead times are given for information purposes only, no liability can be incurred should they be exceeded.
They are to be considered as the time of leaving our factory. The lead time for receipt = the time to prepare and pack the order + any special services + delivery time by our carrier.
- For payment by bank card: the date of the order and payment activates the countdown to the delivery time
- For payments by cheque or transfer, the date of receipt of payment activates the countdown to the delivery time
An invoice will be sent with your parcel. This matches the items that have been prepared and dispatched.
Delivery by carrier
The transport delivery time in France is between 48 and 72 hours according to the destination town. For other countries, this is according to the destination and the order content.
Once your order has been collected by our carrier, you will receive an email enabling you to track the delivery.
If you are absent at the time of delivery, the carrier will usually leave a non-delivery notice so you can contact them to arrange another delivery time.
Delivery to a collection point
You will be advised of your parcel’s arrival at your specified collection point. From this time, you have 10 days to collect your parcel, during the collection point opening times.
After this period, the parcel will be returned to us. In this case, the price of your parcel will be refunded, following deduction of the collection point return costs (which will be charged to us) + €5 for administration charges.
Made-to-measure products cannot be refunded and will be destroyed.
Article 05 - warranty:
The warranty does not cover defects and the consequences thereof resulting from:
- interventions by a restorer or tailor not certified by brise-vue.com;
- any incorrect use or failure to maintain the products;
- any use other than for the product’s intended purpose.
Customers are entitled to the legal warranty of fitness for purpose and the legal warranty against defects in purchased items in accordance with the following provisions:
- Articles L217-4, L217-5, L217-7, L217-8, L217-9, L217-10, L217-11 and L217-12 of the French Consumer Code
- Articles 1641, 1642, 1643, 1644, 1645, 1646, 1647 and 1648 of the French Civil Code
Article 06 - withdrawal:
Under articles L121-16 and L221-18 of the french consumer code, the buyer enjoys a period of 14 clear days from delivery of their order to return the product to the seller for exchange or refund. The goods must be returned in their original packaging together with the original invoice. The return transportation costs are to be paid by the buyer.
Made-to-measure products and decorative privacy screens are tailor-made products, they are not included in this case and cannot be refunded (art. L121-20-2 and L221-18 of the french consumer code).
These products benefit from a tolerated difference of 1 to 2 cm to offset the risk of slight shrinkage in hot conditions.
The customer’s signature on the receipt slip signifies that the products have arrived at his/her home in good condition and that s/he may not make any complaint relative to the transport, missing items or damage.
The carrier must be informed of any suspicions concerning the parcel at the time of receipt and prior to signing the delivery form, and these must be forwarded within a maximum period of 48 hours.
The customer is advised to check the entire parcel before signing the carrier’s receipt slip.
The goods must be returned in their original packaging together with the original invoice. The return transportation costs are to be paid by the buyer.
Article 07 - photos:
Photographs illustrating products, thumbnails and mood photos do not fall within the scope of the contract.
We take the greatest care that our product thumbnails portray the real colours of our products as closely as possible. However, depending on the website user’s screen quality or the ambient lighting conditions, it should be noted that there may be apparent differences between the photo and the actual product. The liability of bouillon s.a.r.l cannot be invoked in any way.
Samples may be requested for the majority of our products to enable you to assess their actual appearance.
Article 08 – intellectual property:
The general structure of the website, as well as the texts, animated or still images, expertise and all other elements included on the site are the exclusive property of BOUILLON SARL.
Any representation of this website in whole or in part, by any person whatsoever, without the express authorisation of BOUILLON SARL, is prohibited and constitutes an infringement under Articles L. 335-2 et seq. Of the Intellectual Property Code.
This also applies to databases (if applicable) featured on the website, which are protected by the provisions of the French law of 1 July 1998 that adapted the Intellectual Property Code from the directive of 11 March 1996 relative to the legal protection of databases.
The ‘BRISE-VUE’ brand name and logo shown on the website are registered trademarks. Any total or partial reproduction of these brand names and logos is therefore prohibited.
Article 09 – legal disputes:
In the event of a dispute relating to a product or its payment, the parties agree prior to any court action that any claim will be the object of prior formal notice by way of a recorded delivery letter with acknowledgement of receipt.
Either party may then, after a period of ten (10) days from dispatch of the abovementioned letter, commence appropriate proceedings, authority being attributed expressly to the courts in the town of douai.
Article 10 – legal information:
It is necessary to provide personally identifiable information for the purposes of distance selling, as this information is essential for processing and delivering orders, as well as drawing up invoices and warranties. Failure to supply this information will result in the order not being validated. In compliance with the french ‘informatique et libertés’ data protection law, the processing of personal customer data must be registered with the cnil (french data protection authority). Customers have the right to access, modify, correct and delete all personal information (article 34 of the law of 6 january 1978); this right can be exercised by contacting bouillon s.a.r.l.
